Israel-Palestine: Netanyahu's "Gestures" After Talks with Mitchell (Yenidunya)

After his contact with US special envoy George Mitchell, Israeli Prime Minister Benjamin Netanyahu said that as part of the indirect talks he would be open to a "frank exchange of views" regarding the core issues. Thus the Netanyahu Government looks towards direct talks after agreement on common points on core issues, especially on borders.

Meanwhile, Israel is aiming to satisfy both Washington and Ramallah through the  "gesture" of  a de facto freeze on construction in the eastern sector of Jerusalem.


Although Netanyahu has said repeatedly that East Jerusalem will remain under Israeli sovereignty, Jerusalem Councilman Meir Margalit of the dovish Meretz Party said on Monday that top Jerusalem officials told him that Netanyahu's office had ordered a halt to building. The shift occurredafter Washington expressed anger over the construction plans announced during US.Vice President Joe Biden's visit. Margalit added that the committees that deal with construction are not even meeting anymore.

Despite Haaretz's report in January that dozens of settlements in the West Bank were going through a building boom, the Netanyahu Government is claiming "progress" after the most recent meeting with Mitchell. Israel Defense Forces troops on Tuesday destroyed at least 10 Jewish structures in the West Bank as a requirement of the Prime Minister's declaration of a 10-month-freeze in expansion.

The new Israeli policy of deporting Palestinians from the West Bank on arbitrary grounds has kicked in with Ahmad Sabah, who has just been deported to Gaza and separated from his family in the West Bank. The measure contravenes the Geneva Convention of 1949 on the treatment of occupied populations, and it also goes contrary to the undertakings Israel made toward the Palestine Authority in the course of the Oslo peace negotiations.

The episode underlines the ways in which their forced statelessness leaves Palestinians (almost uniquely among major world nationalities) completely vulnerable to loss of the most basic human rights. That he was forcibly moved to Gaza by the Israelis suggests that many of those singled out for potential deportation from the West Bank may be moved to the small slum along the Mediterranean, which the Israelis have cut off from its traditional markets and which they keep under a blockade of the civilian population (a war crime). The Israeli establishment has decided not to try to colonize Gaza, and its isolation and hopelessness make it an attractive place for them to begin exiling West Bank residents, thus making more room for Israeli colonists.


The new policy, which is illegal six ways to Sunday in international law, is the brainchild of the government of far rightwing Likud leader Binyamin Netanyahu.

Netanyahu, an Israeli hawk and expansionist, slapped President Barack Obama in the face again Thursday when he confirmed that he refused to halt construction of new homes in Palestinian East Jerusalem, which is militarily occupied by Israel.

Netanyahu’s announcement is probably the nail in the coffin of any two-state solution to the Israeli-Palestinian conflict (in which the Israelis have thrown most Palestinians now living beyond the Green Line off their land and deprived them of citizenship in a state and all the rights that go with such citizenship). Palestinians are so despairing that only 57 percent even believe in having an independent Palestinian state any more. The rest are resigned to becoming Israelis in the distant future, when demographic realities and perhaps world-wide boycotts of Israel for its Apartheid-style policies toward the occupied Palestinian will force Israel to accept them.

At the same time, Netanyahu tried to throw sand in peoples’ eyes by talking about recognizing an ‘interim’ Palestinian state with “temporary” borders.

Palestinian leaders reject this formulation, which is intended to allow the Israelis to continue aggressively to colonize Palestinian territory while pretending that they are engaged in a ‘peace process.’ The Palestine Authority, established in the 1990s, was already a sort of interim state then, and Palestine’s borders were then ‘temporary.’ So temporary that Israel has made deep inroads into them through massive colonies and building a wall on the Palestinian side of the border, cutting residents off from their own farms and sequestering entire towns and cities.

Netanyahu’s various moves this week, from illegally expelling a Palestinian from the West Bank to Gaza to blowing off the president of the United States and hitching his wagon to massive increased colonization of Palestinian land: all of these steps are guaranteed to mire Israel in violent disputes for years and perhaps decades. And the US, which has already suffered tremendously in Iraq and elsewhere from its knee-jerk support of illegal and inhumane Israeli policies toward the Palestinians, will suffer further.

Meanwhile, in the wake of a vicious attack on Barack Obama by New York senator Chuck Schumer, Steve Clemons of the Washington Note frankly wonders whether Schumer understands he is in the US Senate or whether he is under the impression he is serving in the Israeli Knesset.

Israel-Palestine Follow-Up:"Apartheid" Deportation Orders; Settlements

Responding to Israel's new military order which can deport tens of thousands of Palestinians from the West Bank, the Palestinian Authority's chief negotiator Saeb Erekat said Sunday:

These military orders belong in an apartheid state. Extensive in scope, they make it infinitely easier for Israel to imprison and expel Palestinians from the West Bank. They are an assault on ordinary Palestinians, and an affront to the most fundamental principles of human rights.

These orders have the effect of turning Palestinians into criminals in their own homes, while directly undermining the efforts of Palestinians to run their own internal affairs. They also open the flood gate for Israel to target foreign-born spouses, foreign workers, and even Israeli citizens as ‘infiltrators’, as well as anyone participating in demonstrations in support of Palestinian rights and against Israel’s occupation.


Most of all, they reveal the invidious design behind Israel’s settlement policy. The fewer Palestinians there are in the West Bank, including in occupied East Jerusalem, the more settlers there will be. Israel’s endgame is not peace. It is the colonization of the West Bank.

By systematically violating past agreements, as for example in its refusal to freeze settlements, and undermining international efforts to resume negotiations, Israel is turning the Palestinian-Israeli conflict into a zero sum game. At a time when the international community is trying to create an environment conducive to negotiations, these military orders achieve the exact opposite result.

Palestine has long been a litmus test of the international community’s commitment to international law and its defense of basic rights and liberties. The international community must live up to its responsibility and protect the rights of Palestinians. Peace demands nothing less.

Israel will argue that expulsions are justified because Palestinians are breaking the law. But this argument counts for nothing when that law belongs to a system of apartheid and only serves to strengthen Israel’s 43-year long illegal occupation.

Meanwhile, Haaretz says that construction requiring the approval of Jerusalem's district planning committee has been halted for more than a month through instructions sent to the Jerusalem District Planning and Building Committee.

On Sunday, the Jerusalem municipality said that they were showing sensitivity to the issue but added that there was no intention to stop the work of the local committee. .

The Prime Minister's Office has issued a statement:

The building and planning policy in Jerusalem has not changed and is identical to that conducted by all Israeli governments. In the course of drawing lessons from the incident at the time of U.S. Vice President Joe Biden's visit to Israel, procedure is currently being developed that will ensure that an incident such as this is not repeated with respect to the timing of the release of proceedings of diplomatic sensitivity.

A new military order aiming at "preventing infiltration" through deportation and/or punishment of thousands of Palestinians in the West Bank will come into force this week. Those whose ID cards bear home addresses in the Gaza Strip --- not only people born in Gaza but any of their children born in the West Bank --- those born in the West Bank or abroad who have lost their residency status, and foreign-born spouses of Palestinians are "infiltrators". They are subject to deportation, a fine of NIS 7500, and/or a jail sentence of up to seven years.

Despite this violation of the Oslo Accords, Palestinians with Gaza addresses have been defined since 2000 as illegal sojourners, as if they were citizens of a foreign state. Many of them, including those born in the West Bank, have been "deported" to Gaza.



Since 2007, Palestinians with Gaza addresses have had the right to request a permit to stay in the West Bank. Indeed, since 2009, residents of East Jerusalem have no need for permission to enter Area A, which is under the control of the Palestinian Authority. This new order not only supersedes these regulations but, broadening the definition of "infiltration", and brings more Palestinians into the category of potential criminals. The term infiltrator will also be applied to Palestinian residents of Jerusalem, citizens of countries with whom Israel has friendly ties (such as the US), and Israeli citizens, whether Arab or Jewish.

Who is to judge whether someone is an "infiltrator"? Israel Defense Forces commanders in the field. So who can determine who can reside in Jericho, Ramallah, Nablus, or Hebron? Israeli commanders or the Palestinian Authority?

With this measure, Israel is provoking the "other", violating its agreements and doing its best to delegitimize the Palestinian leadership, in the eyes of both Palestinians and Israelis. It is a contradiction of Israel's official expectation that the West Bank authorities will come to the table as a "partner state"; curtailed and publicly belittled, this is a half-partner lacking the basic functions of a Government.

And so West Jerusalem, at the level of the practical rather than Washington's invocation of the rhetorical, blocks the peace process itself.

Palestinian Money Channelled into Israel?: Haaretz reports the Justice Ministry’s intervention between the Finance Ministry and the Civil Administration in Area C of the West Bank. The dispute is whether the Civil Administration in the West Bank should be compensated for hundreds of millions of shekels, to be used for operational expenses as well as for infrastructure and welfare services for Palestinians, collected in the West Bank and given to the State of Israel. According to international law, an occupying power is prohibited from claiming the benefits of economic activity in an occupied territory.

A lawyer at the Military Advocate General's Office said the transfer of such funds to the state was improper and should cease. The Civil Administration has requested that the money again be given directly to it. However, the Finance Ministry claims that in the past 15 years the state has invested in the West Bank more than double the amount it has collected.



New Peace Plan on the Way?: Speaking to columnist David Ignatius on Wednesday, two top officials in Washington stated that President Barack Obama is weighing the possibility of submitting a new American Middle East peace plan by this fall.

All core issues are to be discussed with the beginning of negotiations. One of the officials, with reference to Camp David in 2000, claimed that "90 percent of the map would look the same.”

It was also stated that the planned peace plan would be linked with other regional problems. One official told Ignatius:

We want to get the debate away from settlements and East Jerusalem and take it to a 30,000-feet level that can involve Jordan, Syria and other countries in the region.

Netanyahu's Confession on East Jerusalem: On the anniversary of his government’s coming to power, Prime Minister Benjamin Netanyahu said Wednesday he has not yet worked out his differences with Washington over a disputed construction project in East Jerusalem.

In response, Kadima criticized Likud and Netanyahu harshly:

Netanyahu lives in Bibiland, not in Israel.

Netanyahu’s trickery is meant to throw sand in the eyes of the public and artificially blur the crushing failure of the most over-sized and wasteful government in Israel's history.

Unclenching Fists With Obama: Religious terms such as "Islamic extremism" are to be removed from the National Security Strategy document under President Obama. Breaking from the Bush Administration's language that “the struggle against militant Islamic radicalism is the great ideological conflict of the early years of the 21st century”, the strategy document is being re-written without any phrase that can target Islam.

Turkish-Israeli Relations: The tension between Turkey and Israel remains along with the continuation of defensive alliance between two countries. Turkish Prime Minister Recep Tayyip Erdogan said Wednesday that “Israel is the main threat to peace in the Middle East.”

Erdogan said that it is impossible to praise a country that exerted such excessive force in Gaza, including the use of phosphorus weapons. He also criticized Israel for not signing the Nuclear Non-Proliferation Treaty, saying Israel should not be exempt from international supervision of its nuclear facilities.

On the same day, a ceremony was held in Turkey to mark the completion of a project in which the Israeli defense contracting firm Elbit upgraded 170 tanks for the Turkish army.
