US-Israel: The Big Fight Within Obama Administration --- Ross v. Mitchell, NSC v. State Department

Laura Rozen of Politico returns to top inside reporter form with this piece on the division over Israel policy within the Obama Administration, in particular between Dennis Ross of the National Security Council and Obama's special envoy for the Middle East, George Mitchell.

Yet read this carefully and you'll pick up an even bigger story. This doesn't look like just Ross v. Mitchell but a battle between the National Security Council and the State Department.  Note the strength of the anti-Ross feeling amongst the unnamed officials and ask yourself, "Where are their desks in Washington?"

Then note the quick defense of Ross and dismissal of any tension by his NSC bosses, as well as the "other contacts", also likely to be in the NSC, who defend Ross's Israel line as part of a sensible approach to the "big picture" of the Middle East and Iran.

This is the "inside" part of the headline tension between the US and Israeli Governments. Just as something will have to give --- and someone will have to lose --- in that context, so someone will have to suffer defeat, possibly to the point of resignation, within the Obama Administration. Whether that is Ross or Mitchell will say a lot for which agency gets the upper hand in the Administration's foreign policy, particularly on Israel-Palestine and on Iran.

Middle East Inside Line: Arab League/Turkey Criticism of Israel, Peres v. Netanyahu, Armenia Complication for Turkey-Israel?


Since Israeli Prime Minister Benjamin Netanyahu’s tense visit to the White House last week, an intense debate inside the Obama administration about how to proceed with Netanyahu to advance the Middle East peace process has grown more heated, even as Israeli officials are expected to announce they have reached some sort of agreement with Washington as soon as tonight.


Sources say within the inter-agency process, White House Middle East strategist Dennis Ross is staking out a position that Washington needs to be sensitive to Netanyahu’s domestic political constraints including over the issue of building in East Jerusalem in order to not raise new Arab demands, while other officials including some aligned with Middle East peace envoy George Mitchell are arguing Washington needs to hold firm in pressing Netanyahu for written commitments to avoid provocations that imperil Israeli-Palestinian peace talks and to preserve the Obama administration's credibility.

POLITICO spoke with several officials who confirmed the debate and its intensity. Ross did not respond to a query, nor did a spokesman for George Mitchell. 

“He [Ross] seems to be far more sensitive to Netanyahu's coalition politics than to U.S. interests,” one U.S. official told POLITICO Saturday. “And he doesn't seem to understand that this has become bigger than Jerusalem but is rather about the credibility of this Administration.”

What some saw as the suggestion of dual loyalties shows how heated the debate has become.

"The assertion is as false as it is offensive," McDonough said Sunday by email. "Whoever said it has no idea what they are talking about. Dennis Ross's many decades of service speak volumes about his commitment to this country and to our vital interests, and he is a critical part of the President's team."]

Last week, during U.S.-Israeli negotiations during Netanyahu’s visit and subsequent internal U.S. government meetings, the first official said, Ross “was always saying about how far Bibi could go and not go. So by his logic, our objectives and interests were less important than pre-emptive capitulation to what he described as Bibi's coalition's red lines.”

When the U.S. and Israel are seen to publicly diverge on an issue such as East Jerusalem construction, the official characterized Ross's argument as: "the Arabs increase their demands ... therefore we must rush to close gaps ... no matter what the cost to our broader credibility.”

A second official confirmed the broad outlines of the current debate within the administration. Obviously at every stage of the process, the Obama Middle East team faces tactical decisions about what to push for, who to push, how hard to push, he described. 

As to which argument best reflects the wishes of the President, the first official said, “As for POTUS, what happens in practice is that POTUS, rightly, gives broad direction. He doesn't, and shouldn't, get bogged down in minutiae. But Dennis uses the minutiae to blur the big picture … And no one asks the question: why, since his approach in the Oslo years was such an abysmal failure, is he back, peddling the same snake oil?”

Other contacts [Editor's Note: almost certainly NSC officials] who have discussed recent U.S.-Israel tensions with Ross say he argues that all parties need to keep focus on the big picture, Iran, and the peace process as being part of a wider U.S. effort to bolster an international and regional alliance including Arab nations and Israel to pressure and isolate Iran.

This is an argument that presumably has resonance with the Netanyahu government. But at the same time, Arab allies tell Washington that Israeli construction in East Jerusalem inflames their publics and breeds despair and makes it hard for them to work even indirectly and quietly with Israel on Iran. They push Washington to show it can manage Israel and to get an Israeli-Palestinian peace process going that would facilitate regional cooperation on Iran.

Israel: So What is This Government Crisis? (Carlstrom)

UPDATE 1345 GMT: Laura Rozen of Politico has just posted a different view of the Israeli Prime Minister:

Netanyahu departed Washington for Israel late Wednesday night, after what some sources described as a sometimes frantic last 24 hours of decision-making after a late night meeting with Obama at the White House Tuesday night.

Netanyahu was reported to have spent part of the day Wednesday in a secure room in the Israeli Embassy making calls back to advisors in Israel, after canceling a round of interviews he had been scheduled to have with the media Wednesday morning. He also met with Sen. George Mitchell and his advisors worked with Dennis Ross and Dan Shapiro to try to come to agreement on a written document of confidence building measures Netanyahu would agree to, but could not close the gap.

“Apparently Bibi is very nervous, frantically calling his ‘seven,’ trying to figure out what to do,” one Washington Middle East hand said Wednesday. “The word I heard most today was ‘panic.’"

Gregg Carlstrom, writing for The Majlis, tells some home truths about the supposed crisis in the Netanyahu Government and its constraint on the Israeli Prime Minister:

Yedioth Ahronoth quotes a bunch of unnamed "commentators" -- every journalist's best friend! -- who think Netanyahu's coalition government is about to collapse. So does an unnamed minister from the Labor party, who thinks Bibi will have to replace right-wing parties like Shas and Yisrael Beiteinu with Kadima:


A Labor minister said Thursday that "the government in its current state may be in danger". But a senior Likud minister disagreed, saying that it was "too soon to assume that the composition of the coalition will change".

Israel Special: Obama-Netanyahu Meeting and the Settlement “Surprise”


I think the Likud minister gets it right. Coalitions don't just collapse, after all; Netanyahu would have to make some policy decision that causes the right-wing parties to withdraw.

Obviously we're talking about a settlement freeze in East Jerusalem -- a decision Bibi has shown no desire to make. He said this week that the Palestinian insistence on an East Jerusalem freeze would delay peace talks, calling it an "illogical and unreasonable demand." And Interior Minister Eli Yishai told a Shas-affiliated newspaper that construction will continue.
"I thank God I have been given the opportunity to be the minister who approves the construction of thousands of housing units in Jerusalem," Yishai said in an interview with ultra-Orthodox newspaper Yom Yom.

Daniel Hershkowitz, the science and technology minister (from the right-wing Habayit Hayehudi party) praised Netanyahu for standing up for (what he perceives as) Israel's interests; Silvan Shalom, the deputy prime minister, also commended Netanyahu for his response to "American pressure."

Doesn't seem like there's any crisis in this coalition right now. There will be, if Netanyahu freezes construction in East Jerusalem -- but that doesn't seem likely.

Mr Obama's War on Terror: Military Tribunals, Indefinite Detention, No Due Process

I recently heard a well-placed US Government representative say flatly and firmly, in response to a question about the still-far-from-closed Guantanamo Bay facility, that the Obama Administration is not pursuing "indefinite detention" of those imprisoned at Gitmo and elsewhere. Hmm....

The Obama administration has made explicitly clear its intention to deny civilian trials to scores of detainees, by sending some to military commissions and imprisoning others indefinitely without any charges.  And for those cases where it has deigned to provide real due process -- such as its decision to try the 9/11 defendants in a criminal court -- it is moving in the wrong direction.  Obama officials are clearly signaling their intention to reverse that decision and instead place those defendants before military commissions, and yesterday, yet another piece appeared -- this time in Politico -- describing the beautiful, loving, cooperative relationship between [Obama Chief of Staff] Rahm Emanuel and [Republican Senator] Lindsey Graham, which is now "embracing a wide-ranging deal pitched by Graham that would shut down the prison [at Guantanamo]; provide funding to move detainees to Thomson, Ill.; keep the Sept. 11 trials out of civilian courts; and create broad new powers to hold terror suspects indefinitely."  And the endless cavalcade of Rahm-planted, Rahm-Was-Right articles (see the latest from the [Washington] Post today) invariably features his opposition to civilian trials for accused Terrorists as proof of his Centrist though mistakenly rejected wisdom.  

 

In contrast to America's still-growing refusal to accord basic due process to accused Terrorists, consider how Pakistan treats foreigners whom it apprehends within its borders on serious charges of Terrorism:   
SARGODHA, Pakistan -- Prosecutors seeking to indict five Americans on terror-related offenses presented their case to a Pakistani judge Tuesday, laying out charges including waging war against Pakistan and plotting to attack the country, a defense attorney said.The men, all young Muslims from the Washington, D.C., area, were arrested in December in Punjab province not long after reaching Pakistan. . . . The men could be indicted on as many as seven charges during their next hearing on March 10, lawyer Hamid Malik told The Associated Press. The judge ordered the defense to review the prosecution report presented in the Sargodha town court and to prepare a rebuttal.  

If there's any country which can legitimately claim that Islamic radicalism poses an existential threat to its system of government, it's Pakistan.  Yet what happens when they want to imprison foreign Terrorism suspects?  They indict them and charge them with crimes, put them in their real court system, guarantee them access to lawyers, and can punish them only upon a finding of guilt.  Pakistan is hardly the Beacon of Western Justice -- its intelligence service has a long, clear and brutal record of torturing detainees (and these particular suspects claim they were jointly tortured by Pakistani agents and American FBI agents, which both governments deny).  But just as is true for virtually every Western nation other than the U.S., Pakistan charges and tries Terrorism suspects in its real court system. The U.S. -- first under the Bush administration and now, increasingly, under Obama -- is more and more alone in its cowardly insistence that special, new tribunals must be invented, or denied entirely, for those whom it wishes to imprison as Terrorists (along those same lines, my favorite story of the last year continues to be that the U.S. compiled a "hit list" of Afghan citizens it suspected of drug smuggling and thus wanted to assassinate [just as we do for our own citizens suspected of Terrorism], only for Afghan officials -- whom we're there to generously teach about Democracy -- to object on the grounds that the policy would violate their conceptions of due process and the rule of law).  Most remarkably, none of this will even slightly deter our self-loving political and media elites from continuing to demand that the Obama administration act as self-anointed International Arbiter of Justice and lecture the rest of the world about their violations of human rights.
