"American Takfiris": The US Proponents of Torture (and Why It Matters)

The theological justification for al Qaeda's wholesale slaughter of civilians was provided by Sayyid Imam al-Sharif, also known as Dr. Fadl, one of the founding fathers of al Qaeda. Because the murder of innocents is forbidden in Islam and the murder of Muslims in particular, Ayman al-Zawahiri and Osama bin Laden required some sort of theological framework for justifying terrorism. This was provided by al-Sharif, who essentially argued in his book, "The Compendium of the Pursuit of Divine Knowledge," that apostates could be murdered, and that approach, takfir (which has come to be known as takfirism) allowed al Qaeda to, for all intents and purposes, kill anyone they wanted without violating the laws of Islam by declaring them to be apostates. In other words, Dr. Fadl helped provided a theological justification for something that everyone involved knew was wrong.

The legal memos justifying torture aren't very different in terms of reasoning--it's clear that John Yoo and his cohorts in the Office of Legal Counsel saw their job not as binding the president to the rule of law, but to declare legal any tactic that the executive branch believed necessary to fight terrorism. They worked backwards from this conclusion, and ethics officials at the Department of Justice, we now know, decided that they they had violated professional standards in doing so. Whereas al-Zawahiri and bin Laden turned to al-Sharif for a method to circumvent the plain language of the Koran, Bush and Cheney went to Yoo and Jay Bybee to circumvent the plain language of the law. Most Islamic scholars, just like most legal experts, reject their respective reasoning as unsound.



The torture memos--indeed, all of the pro-torture arguments rest on a similar intellectual themes to the takfiris. Suspected terrorists are "illegal enemy combatants", outside the framework of laws that would otherwise guide us. Just as the takfiris justify the killing of even self-identified Muslims by excommunicating them as "infidels", torture apologists argue that even American citizens like Jose Padilla who are accused of being terrorists become legal "apostates" without any rights the president is bound to respect. These are extraordinary circumstances, this is an extraordinary war--and so, the Bush administration turned to Yoo, a man who believes the president is bound by no laws during wartime: he can murder a village of innocent civilian non-combatants just as surely as he can crush the testicles of a child or deploy the military against residents of the United States. The architects of torture are the intellectual mirror image of their declared enemies, depending on the perceived inhumanity of their foes to justify monstrous actions. It's worth noting however, that the Bush administration did not take full advantage of the wrongs that the lawyers in their Office of Legal Counsel would have enabled. My point is not to equate the deeds of AQ with the deeds of the Bush administration--merely to point out justification for acts that are on their face unjustifiable take a similar intellectual path.

From his cell in an Egyptian prison, al-Sharif denounced his former colleagues in al Qaeda, declaring that the killing of innocents was wrong. He essentially renounced his earlier work providing the theological basis for politically motivated murder and destruction, declaring, "There is no such thing in Islam as ends justifying the means," now arguing that the murder of innocents, Muslim or otherwise, was sinful. Whatever theological cover al-Sharif's original arguments provided were meaningless against the body count of mostly Muslim innocents amassed by al-Qaeda in their war against the "West", which by the numbers has been a war against fellow Muslims. In combination with the furious efforts of moderate Muslims and even committed Islamists like al-Sharif, al Qaeda and its methods have been largely discredited, to the point where, as Fareed Zakaria writes, we don't fear "a broad political movement but a handful of fanatics scattered across the globe."

I confess to being bothered that we haven't seen a similarly backlash against the architects of torture here--part of the reason we haven't, is because even though innocents were tortured, we still see them as fundamentally alien. Few Americans directly suffered as a result of what Yoo and Bybee did--although I think we have yet to understand that damage that's been done to our society as a whole. Bolstered by ideological partisans and powerful figures looking to avoid accountability for their actions, men like John Yoo and Jay Bybee have yet to be held responsible for the crimes they enabled--and I'm not sure they ever will be--although I'm less concerned with their punishment than with the permanent American rejection of torture. The Justice Department's David Margolis overruled the original conclusions of the Department's ethics lawyers that Yoo and Bybee had, in ignoring legal precedents and sanctioning behavior that was likely illegal, had committed "professional misconduct". That would have triggered professional sanctions for Yoo, a tenured professor at Berkeley, and Bybee, a sitting federal judge, but Margolis' memo instead concludes that they had excercised "flawed legal reasoning" that could be forgiven in part because of the context in which the memos were written, months after the 9/11 attacks. Margolis though, does not endorse their reasoning, and as for Yoo, he writes that whether or not he deliberately gave bad legal advice is a "close question."  Al-Sharif will never be able to wash the blood from his hands, but while this founding father of al Qaeda has recoiled from the fruits of his labor, the American architects of torture continue to argue that their reasoning is legally sound.

The American conscience, when it decides to act, is mighty--but it is also sluggish and vain. Americans are crushed by the weight of not fulfilling their own high expectations--so the shameful acts of one generation are often rectified by a subsequent generation unencumbered by their own complicity in such acts. So the compromise the Founding Fathers reached on the issue of slavery, in defiance of the spirit of the documents they authored, was eventually righted by the Civil War. The slavery by another name of reconstruction was ignored by a nation weary of conflict after nearly being rent in two--but eventually gave birth to the civil rights movement. The suffragettes were forced to accept a compromise on the 14th Amendment that denied them the vote--but they would ultimately prevail. Roosevelt interned Japanese Americans, Reagan gave them reparations. The American conscience is often slow to action, but not because it cannot recognize evil--but because our view of ourselves as a people guided by justice is so important to who we are that when confronted with proof of our own shortcomings, we recoil in shame and precious vanity. Eventually, with the big stuff, we usually find our way--we see this with our slow, staggering, but inevitable march towards full personhood for gays and lesbians.  And while those who stained America's honor with war crimes have escaped accountability for now, these American takfiris will eventually be judged by history with a clarity we cannot muster today.

Revisiting 9/11: Did the US Misread Afghanistan and Bin Laden?

Evidence now available from various sources, including recently declassified U.S. State Department documents, shows that the Taliban regime led by Mullah Mohammad Omar imposed strict isolation on Osama bin Laden after 1998 to prevent him from carrying out any plots against the United States.

The evidence contradicts the claims by top officials of the Barack Obama administration that Mullah Omar was complicit in Osama bin Laden's involvement in the al Qaeda plot to carry out the terrorist attacks in the United States on Sep. 11, 2001. It also bolsters the credibility of Taliban statements in recent months asserting that it has no interest in al Qaeda's global jihadist aims.

The Afghanistan Occupation: 700 Military Bases (and Counting)

A primary source on the relationship between bin Laden and Mullah Omar before 9/11 is a detailed personal account provided by Egyptian jihadist Abu'l Walid al-Masri published on Arabic-language jihadist websites in 1997.



Al-Masri had a unique knowledge of the subject, because he worked closely with both bin Laden and the Taliban during the period. He was a member of bin Laden's Arab entourage in Afghanistan, but became much more sympathetic to the Afghan cause than bin Laden and other al Qaeda officials from 1998 through 2001.

The first published English-language report on al-Masri's account, however, was an article in the January issue of the CTC Sentinel, the journal of the Combating Terrorism Center (CTC) at West Point, by Vahid Brown, a fellow at the CTC.

Mullah Omar's willingness to allow bin Laden to remain in Afghanistan was conditioned from the beginning, according to al-Masri's account, on two prohibitions on his activities: bin Laden was forbidden to talk to the media without the consent of the Taliban regime or to make plans to attack U.S. targets.

Former Taliban Foreign Minister Wakil Ahmed Muttawakil told IPS in an interview that the regime "put bin Laden in Kandahar to control him better." Kandahar remained the Taliban political headquarters after the organisation's seizure of power in 1996.

The August 1998 U.S. cruise missile strikes against training camps in Afghanistan run by bin Laden in retaliation for the bombings of two U.S. Embassies in East Africa on Aug. 7, 1998 appears to have had a dramatic impact on Mullah Omar and the Taliban regime's policy toward bin Laden.

Two days after the strike, Omar unexpectedly entered a phone conversation between a State Department official and one of his aides, and told the U.S. official he was unaware of any evidence that bin Laden "had engaged in or planned terrorist acts while on Afghan soil". The Taliban leader said he was "open to dialogue" with the United States and asked for evidence of bin Laden's involvement, according to the State Department cable reporting the conversation.

Only three weeks after Omar asked for evidence against bin Laden, the al Qaeda leader sought to allay Taliban suspicions by appearing to accept the prohibition by Omar against planning any actions against the United States.

"There is an opinion among the Taliban that we should not move from within Afghanistan against any other state," bin Laden said in an interview with al Jazeera. "This was the decision of the Commander of the Faithful, as is known."

Mullah Omar had taken the title "Commander of the Faithful", the term used by some Muslim Caliphs in the past to claim to be "leader of the Muslims", in April 1996, five months before Kabul fell to the Taliban forces.

During September and October 1998, the Taliban regime apparently sought to position itself to turn bin Laden over to the Saudi government as part of a deal by getting a ruling by the Afghan Supreme Court that he was guilty of the Embassy bombings.

In a conversation with the U.S. chargé in Islamabad on Nov. 28, 1998, Wakil Ahmed Muttawakil, Omar's spokesman and chief adviser on foreign affairs, referred to a previous Taliban request to the United States for evidence of bin Laden's guilt to be examined by the Afghan Supreme Court, according to the U.S. diplomat’s report to the State Department.

Muttawakil said the United States had provided "some papers and a videocassette," but complained that the videocassette had contained nothing new and had therefore not been submitted to the Supreme Court. He told the chargé that the court had ruled that no evidence that had been presented warranted the conviction of bin Laden.

Muttawakil said the court trial approach had "not worked" but suggested that the Taliban regime was now carrying out a strategy to "restrict [bin Laden's] activities in such a way that he would decide to leave of his own volition."

On Feb. 10, 1999, the Taliban sent a group of 10 officers to replace bin Laden's own bodyguards, touching off an exchange of gunfire, according to a New York Times story of Mar. 4, 1999. Three days later, bodyguards working for Taliban intelligence and the Foreign Affairs Ministry personnel took control of bin Laden's compound near Kandahar and took away his satellite telephone, according to the U.S. and Taliban sources cited by the Times.

Taliban official Abdul Hakeem Mujahid, who was then in the Taliban Embassy in Pakistan, confirmed that the 10 Taliban bodyguards had been provided to bin Laden to "supervise him and observe that he will not contact any foreigner or use any communication system in Afghanistan," according to the Times story.

The pressure on bin Laden in 1999 also extended to threats to eliminate al Qaeda’s training camps in Afghanistan. An e-mail from two leading Arab jihadists in Afghanistan to bin Laden in July 1999, later found on a laptop previously belonging to al Qaeda in and purchased by the Wall Street Journal , referred to "problems between you and the Leader of the Faithful" as a "crisis".

The e-mail, published in article by Alan Cullison in the September 2004 issue of The Atlantic, said, "Talk about closing down the camps has spread."

The message even suggested that the jihadists feared the Taliban regime could go so far as to "kick them out" of Afghanistan.

In the face of a new Taliban hostility, bin Laden sought to convince Mullah Omar that he had given his personal allegiance to Omar as a Muslim. In April 2001 bin Laden referred publicly to having sworn allegiance to Mullah Omar as the "Commander of the Faithful".

But al-Masri recalls that bin Laden had refused to personally swear such an oath of allegiance to Omar in 1998-99, and had instead asked al-Masri himself to give the oath to Omar in his stead. Al-Masri suggests that bin Laden deliberately avoided giving the oath of allegiance to Omar personally, so that he would be able to argue within the Arab jihadi community that he was not bound by Omar's strictures on his activities.

Even in summer 2001, as the Taliban regime became increasingly dependent on foreign jihadi troop contingents, including Arabs trained in bin Laden's camps, for its defence against the military advances of the Northern Alliance, Mullah Omar found yet another way to express his unhappiness with bin Laden's presence.

After a series of clashes between al Qaeda forces and those of the Islamic Movement of Uzbekistan (IMU), the Taliban leader intervened to give overall control of foreign volunteer forces to the Tahir Yuldash of the IMU, according to a blog post last October by Leah Farrall, an Australian specialist on jihadi politics in Afghanistan.

In Late January, Geoff Morrell, the spokesman for Defence Secretary Robert Gates, suggested that the United States could not negotiate with Mullah Omar, because he has "the blood of thousands of Americans on his hands," implying that he had knowingly allowed bin Laden’s planning of the 9/11 attacks.

Afghanistan-Pakistan: Talks with Taliban, Top Insurgent Dead?, Fighting Intensifies

Juan Cole offers a valuable overview of a series of important developments in Afghanistan and Pakistan:

Reuters reports that President Hamid Karzai is calling upon the Taliban and other insurgent groups to drop their demand that foreign forces leave the country before agreeing to attend a Loya Jirga or national tribal council in six weeks to seek reconciliation with the Karzai government. Karzai says he will go to Riyadh to seek Saudi mediation, though Foreign Minister Saud al-Faisal says that the kingdom will only host talks if the Taliban and other guerrillas drop their ties to al-Qaeda.

Omar, the son of Osama Bin Laden, maintains that al-Qaeda Arab fighters and their Pashtun Taliban hosts are not in fact close, and that their alliance of convenience is riddled with disagreements.

Radio Azadi reports in Dari Persian that center-right Pakistani politician and former prime minister Nawaz Sharif says that the Pakistani government should initiate the reconciliation talks with the Taliban.


Aljazeera English reports that Ashraf Ghani, former presidential candidate, is confirming that the Afghanistan government has been talking to the Taliban and other insurgents behind the scenes.

Meanwhile, US Marines and troops fighting the insurgents find themselves embroiled in an unconventional struggle in which the enemy has many advantages. There has been no winter lull this year,as the Taliban and other guerrilla groups have resorted increasingly to roadside bombs and sniping at US troops, filling them with anger and desire for revenge. Some 29 US troops were killed in January in Afghanistan, up from 15 in January of 2009. Commanders are attempting to restrain the US military personnel from revenge attacks that would only end all hope of winning local hearts and minds.

Karzai attempted to raise the stakes for Western success in Afghanistan, saying that a US geological survey will soon announce that the country has $1 trillion in petroleum reserves, in addition to substantial copper and iron ore deposits (China has a contract to mine the copper.)

On the Pakistan side of the border, the Pakistani military is investigating press reports that a US drone strike may have killed the leader of the Pakistani Taliban Movement (Tehrik-i Taliban Pakistan or TTP), Hakimu'llah Mahsud. The Taliban maintain that Mahsud is alive. He was pictured in the martyrdom video of the Jordanian double agent, Humam al-Balawi, who attacked the CIA's Forward Operating Base Campbell in late December. He has also been behind a string of deadly bombings against civilian and military targets inside Pakistan.

The TTP faces increasing public anger in Pakistan, and in this weekend's by-election in the Swat valley, which the Movement took over last winter-spring before being forcibly expelled by the Pakistani army this summer, a secular Pashtun nationalist candidate won, defeating more conservative and religious aulternatives. The Pakistani Taliban are driving the Pakistani public into the arms of the secular parties.
