LATEST Iran Urgent: The Deal on Uranium Enrichment (and US Response)

UPDATE 18 MAY, 1445 GMT: Ahh, so here's the apparent response of the Obama Administration, or at least Secretary of State Hillary Clinton: reduce the Iran-Brazil-Turkey agreement to "a number of unanswered questions" and push forward with the high-profile sanctions drive in the United Nations. Clinton's statement, just made to a Senate committee:

“We have reached agreement on a strong draft with the cooperation of both Russia and China. We plan to circulate that draft resolution to the entire Security Council today. And let me say, Mr. Chairman, I think this announcement is as convincing an answer to the efforts undertaken in Tehran over the last few days as any we could provide.”

UPDATE 1745 GMT: The US Government has now made its formal response to the Tehran agreement. It's little more than a "hold the line" statement, issued by White House Press Secretary Robert Gibbs. It gives no clue as to whether Washington was supportive of the Brazilian-Turkish mediation; instead it sets the next challenge: let's see the proposal go to the International Atomic Energy Agency and, possibly, let's see Iran suspend its unilateral push for 20-percent uranium:








We acknowledge the efforts that have been made by Turkey and Brazil. The proposal announced in Tehran must now be conveyed clearly and authoritatively to the IAEA before it can be considered by the international community. Given Iran’s repeated failure to live up to its own commitments, and the need to address fundamental issues related to Iran’s nuclear program, the United States and international community continue to have serious concerns. While it would be a positive step for Iran to transfer low-enriched uranium off of its soil as it agreed to do last October, Iran said today that it would continue its 20% enrichment, which is a direct violation of UN Security Council resolutions and which the Iranian government originally justified by pointing to the need for fuel for the Tehran Research Reactor. Furthermore, the Joint Declaration issued in Tehran is vague about Iran’s willingness to meet with the P5+1 countries to address international concerns about its nuclear program, as it also agreed to do last October.

The United States will continue to work with our international partners, and through the United Nations Security Council, to make it clear to the Iranian government that it must demonstrate through deeds –-- and not simply words –-- its willingness to live up to international obligations or face consequences, including sanctions. Iran must take the steps necessary to assure the international community that its nuclear program is intended exclusively for peaceful purposes, including by complying with U.N. Security Council resolutions and cooperating fully with the IAEA. We remain committed to a diplomatic solution to the Iranian nuclear program, as part of the P5+1 dual track approach, and will be consulting closely with our partners on these developments going forward.



The European Union and Britain have put out similar statements.

UPDATE 1245 GMT: A group of Iranian political activists have declared that today’s uranium agreement, from a “political and economic” stance, is in the interest of the Iranian nation.

Mohammad Bastehnegar, Ezzatollah Sahabi, Taghii Rahmani, Hosein Rafii, Reza Raistoosi, Hossein ShahHosseini, Azam Taleghani, Reza Alijani, and Nezameddin Ghahari asserted that the agreement could end economic sanctions against Iran and lead to “transparency” in Iran’s relationship with the world.

The statement calls for collaboration of both conservative and reformist political activists in supporting this government initiative.

UPDATE 1110 GMT: Trita Parsi gets to the heart of why this arrangement was struck when last October's very similar deal, which reached top-table discussions in Geneva between Iran, the US, and other powers, collapsed. He notes talks between Brazil's Lula and the Supreme Leader: "This is no longer Ahmadinejad's nuclear deal, this is Khamenei's nuclear deal."

UPDATE 1015 GMT: Iranian Foreign Minister Manouchehr Mottaki has offered more details of the proposed uranium swap at a press conference. From Press TV:
Iran will ask the IAEA [International Atomic Energy Agency] to station its personnel in Turkey to monitor the safe-keeping of the dispatched LEU [Tehran's 1200 kilogrammes low-enriched uranium]....The top diplomat underlined Iran will inform the IAEA of its decision "through official channels" within no more than seven days from the Monday meeting.
"Upon the positive response of the Vienna Group --- which includes Russia, France, the United States and the IAEA --- further details of the exchange will be elaborated through a written agreement and proper arrangement between Iran and the Vienna group that specifically committed themselves to deliver 120 cages of fuel needed for the Tehran research reactor (TRR)," noted Mottaki.

If the Vienna Group accepts Iran's terms and conditions, Mottaki said, both parties will "commit themselves to the implementation" of the deal, which requires Iran to deposit its LEU in Turkey within one month, and in return, the Vienna group will deliver 120 kg of fuel required for the Tehran reactor in no later than one year.

UPDATE 0755 GMT: How big is this story for Iranian state media? Islamic Republic News Agency, noting that "Ahmadinejad raised his hands in victory", devotes 6 of its top 9 stories to the agreement. (Fars, on the other hand, has not stepped into line: its top story is on British Foreign Secretary William Hague speaking about the assassination of a Hamas official in Dubai.)

UPDATE 0645 GMT: The Iran-Brazil-Turkey agreement is for a swap of uranium outside Iran, and just as signficant, it involves the 1200 kilogrammes of Tehran's stock that the US and "Western" countries were seeking last autumn.
Iranian Foreign Ministry Spokesman Ramin Mehmanparast said Monday that the Tehran government has agreed to a draft proposal whereby Iran will send some 1200 kg of its 3.5 percent enriched uranium over to Turkey in exchange for a total of 120 kg 20 percent....

The International Atomic Energy Agency (IAEA) will officially receive a letter with regards to the swap deal "within a week".

According to a Press TV correspondent, the swap will take place nearly a month after receiving official approval from the Vienna Group, which consists of representatives from Iran, France, Russia and the US and the IAEA.

Now watch carefully for the reaction from Washington. If it is favourable, even cautiously favourable, we've got a major breakthrough.

The dominant story in both Iranian and non-Iranian media today is likely to be the announcement between Iran, Brazil, and Turkey of an agreed procedure for a deal on enrichment of Iran's uranium.

No details will be available until later today, so significant questions remain. It is not clear whether Tehran has given any way to the essential demand of the US and other members of the "5+1" (UK, France, Germany, Russia, China) for a swap of uranium outside Iran. Politically, Washington's position --- has it privately supported the Brazilian and Turkish discussions? --- is murky.

The seriousness of the talks, however, is indicated not only by their 17-hour duration on Sunday but also by the level of involvement. Turkish Prime Minister Recep Tayyip Erdogan's postponement on Friday of his trip to Iran did not, in the end, mean that Turkey had withdrawn altogether. Rather, this seems to have been a case of wait-and-see: Turkish "ministers" were involved throughout Sunday: once it was clear that an agreement was possible, Erdogan reversed his position and flew to Tehran, joining Brazilian President Luiz Inacio Lula da Silva.

The core issue is how Iran's 3.5-percent uranium will be exchanged for 20-percent uranium, needed for the Tehran Research Reactor producing medical isotopes.

Iran Analysis: Assessing the Tehran Nuclear Deal (Gary Sick)

Gary Sick, a former official in the Carter and Reagan Administrations and one of the top US-based analysts on Iran, offers an evaluation of today's agreement between Iran, Brazil, and Turkey on a procedure for the enrichment of Tehran's uranium stock:

What to make of the new nuclear agreement by Turkey and Brazil with Iran?

Perhaps the main point is to be reminded of the moral from the old folk tale: Be careful of what you wish for, since you just might get it. The United States took a rather righteous position that the International Atomic Energy Agency (IAEA) and the West had made Iran a remarkably generous offer, and when it was rejected they had no choice but to go all out for sanctions.

There are those in Washington (but also in Paris and London) who were fully committed to passing a strong sanctions resolution in the United Nations Security Council next month, and this is a blow to them and all the intense diplomatic work they have done in the past five or six months. Clearly, it will be immensely more difficult, if not impossible, to get a sanctions resolution if this deal is on the table.


According to preliminary information, the agreement provides that Iran will, within a month, ship 1240 kg of roughly 5 percent low enriched uranium (LEU) to Turkey where it will be held in escrow for up to a year until Iran is provided with 120 kg of fuel cells (uranium enriched to near 20 percent) to replace the nearly exhausted fuel of the Tehran Research Reactor (TRR) that makes medical isotopes. This represents more than half of the 2065 kg of LEU that Iran had produced as of February according to the IAEA, and it greatly reduces Iran’s capability to produce enough fissile material for a bomb.

We should all be reminded of the original purpose of the agreement. It was intended as a confidence-building measure that would open the way to more substantive discussions of other issues. The original offer that Iran provisionally accepted in October tacitly accepted Iran’s right to enrich uranium; in return Iran would give up control over a significant portion of its existing stash of LEU. Even low enriched uranium can be further enriched to create bomb-grade (roughly 90+ percent) highly enriched uranium (HEU) that is required for a bomb. The October agreement would have created an environment conducive to at least minimal mutual trust and the beginning of serious negotiations.

Note to negotiators: In the past six months, Iran has not used its LEU to build a bomb, even without an agreement.

Iran has set up a special line to enrich uranium to the 20 percent required for the TRR, but that line is small, separated from its other enrichment facilities, and under inspection of the IAEA. The move to enrich some uranium to 20 percent was obviously intended as a pressure tactic to drive the West back into negotiations, since Iran does not have the capability to manufacture fuel cells for the TRR.

We should also be reminded that Iran did not reject the original deal: they proposed amending it. Basically, when the Iranian negotiators came home with the proposed deal, they were attacked from all sides –-- including members of the Green Movement –-- for being suckers. Their opponents pointed out that they were going to rely on the word and goodwill of Russia (where the LEU would be enriched to 20 percent) and France (where the fuel cells would be fabricated). Iranians from left to right argued that both of these countries had repeatedly cheated Iran on nuclear issues: Russia by delaying endlessly the completion of the nuclear power plant at Bushehr, and France by refusing to grant Iran rights to the Eurodif enrichment facility partially owned by Iran since the days of the shah. Why, they asked, should we believe that this agreement will be any different?

Instead, they proposed that the swap of LEU for the fuel cells should happen on Iranian soil, probably in stages and within a fixed period of time. That idea was rejected by the United States and its negotiating partners.

The new bargain appears to be a compromise in which the LEU would physically be removed from Iran and held in escrow in Turkey for up to a year, in which time the fuel cells would be manufactured and delivered to Iran. The new bargain also appears to go much further in formally recognizing the legitimacy of Iran’s independent enrichment program. That should not be a surprise given the fact that Brazil, one of the parties to the bargain, has its own enrichment facility similar to Iran’s and in fact concealed its details for some time.

So where does that leave us?

Essentially, it takes us back to last October. The one big difference is that Iran has more LEU now than it did then. But the reality is that Iran will keep producing LEU unless a new agreement is reached to persuade them to stop. If we wait another six months for negotiations, Iran will have still more LEU.

In short, this agreement is largely symbolic and limited in its practical effects. If the West accepts the deal as worked out by Brazil and Turkey, and if a new round of negotiations begins – on both the nuclear and other major issues – then this could be a breakthrough. If the West turns it down, or if the two sides do not use it to negotiate some of the major issues that separate them, then nothing much will have been accomplished.

The next step is up to the United States and its negotiating partners.

Although angst is high among the sanctions-at-all-costs crowd, this path to a nuclear swap deal was fully endorsed by the United States and was the centerpiece of the justification for sanctions. One way to respond at this point may just be to declare that our threat of sanctions worked: Iran has capitulated and we accept yes as an answer.

Iran Document: Text of Iran-Brazil-Turkey Agreement on Uranium Enrichment


JOINT DECLARATION BY IRAN, TURKEY AND BRAZIL
(17 May 2010)


Having met in Tehran, Islamic Republic of Iran, the undersigned have agreed on the following Declaration:

1. We reaffirm our commitment to the Treaty on the Non-Proliferation of Nuclear Weapons and in accordance with the related articles of the NPT, recall the right of all State Parties, including the Islamic Republic of Iran, to develop research, production and use of nuclear energy (as well as nuclear fuel cycle including enrichment activities) for peaceful purposes without discrimination.

2. We express our strong conviction that we have the opportunity now to begin a forward looking process that will create a positive, constructive, non-confrontational atmosphere leading to an era of interaction and cooperation.


3. We believe that the nuclear fuel exchange is instrumental in initiating cooperation in different areas, especially with regard to peaceful nuclear cooperation including nuclear power plant and research reactors construction.

4. Based on this point the nuclear fuel exchange is a starting point to begin cooperation and a positive constructive move forward among nations. Such a move should lead to positive interaction and cooperation in the field of peaceful nuclear activities replacing and avoiding all kinds of confrontation through refraining from measures, actions and rhetorical statements that would jeopardize Iran’s rights and obligations under the NPT.

5. Based on the above, in order to facilitate the nuclear cooperation mentioned above, the Islamic Republic of Iran agrees to deposit 1200 kg LEU in Turkey. While in Turkey this LEU will continue to be the property of Iran. Iran and the IAEA may station observers to monitor the safekeeping of the LEU in Turkey.

6. Iran will notify the IAEA in writing through official channels of its agreement with the above within seven days following the date of this declaration. Upon the positive response of the Vienna Group (US, Russia, France and the IAEA) further details of the exchange will be elaborated through a written agreement and proper arrangement between Iran and the Vienna Group that specifically committed themselves to deliver 120 kg of fuel needed for the Tehran Research Reactor (TRR).

7. When the Vienna Group declares its commitment to this provision, then both parties would commit themselves to the implemention of the agreement mentioned in item 6. Islamic Republic of Iran expressed its readiness to deposit its LEU (1200 kg) within one month. On the basis of the same agreement the Vienna Group should deliver 120 kg fuel required for TRR in no later than one year.

8. In case the provisions of this Declaration are not respected Turkey, upon the request of Iran, will return swiftly and unconditionally Iran’s LEU to Iran.

Middle East Inside Line: Preliminary Proximity Talks, "Strategic Advantage" of Israel's Nukes, Fatah-Hamas Tension

Warming Up the Proximity Talks: US Middle East envoy George Mitchell met Israeli Prime Minister Benjamin Netanyahu on Thursday for the second time in two days. There has been no comment so far.

Mitchell is to go to Ramallah on Friday, meeting the Palestinian Authority leader Mahmoud Abbas.

The official announcement of the beginning of indirect talks is awaiting approval by the Palestine Liberation Organization's Executive Committee. It is expected by Saturday.

Middle East Inside line: Israel’s Nuclear Problem; Syrian Tensions with US & Israel


Israel's "Strategic Advantage": The head of the International Atomic Energy Agency, Yukiya Amano, has asked member states to share views on how to implement a resolution demanding that Israel accede to the Nuclear Non-Proliferation Treaty and open  its nuclear facilities to IAEA oversight.


An Israeli official on Thursday responded by defendeing the country's "opaque" policy on its nuclear program as a "strategic advantage". He added that Israel would not sign the NPT until a comprehensive Arab-Israel peace deal is in place, as the treaty in itself is "not successful" in preventing countries such as Saddam Husein's Iraq or Mahmoud Ahmadinejad's Iran from obtaining nuclear weapons.

Fatah-Hamas Tension: Palestinian Authority President Mahmoud Abbas on Thursday accused the rival Hamas movement of smuggling weapons into the West Bank. In an interview with the London-based A-Sharq al-Awsat, he said:
On the one hand, the organization is punishing those who launch rockets in Gaza, while at the same time it hoards weapons in the West Bank.

Middle East Inside line: Israel's Nuclear Problem; Syrian Tensions with US & Israel

Israel's Nuclear Trouble: On Wednesday, at the United Nations conference on the Nuclear Non-Proliferation Treaty, the ~US, Russia, Britain, France, and China voiced support for making the Middle East a zone free of nuclear arms. There are two messages: one for Iran's nuclear programme and one for Israel's secret nuclear agenda.

"We are committed to a full implementation of the 1995 NPT resolution on the Middle East and we support all ongoing efforts to this end," the five permanent members of the UN Security Council members said in a statement. International Atomic Energy Agency chief Yukia Amano, in a letter, asked foreign ministers of the IAEA's 151 member states to share views on how to implement a resolution demanding that Israel accede to the Non-Proliferation Treaty and throw its nuclear facilities open to IAEA oversight.

Syria-U.S. Relations at Odds?: On Monday, the U.S. renewed the six-year-old economic and diplomatic sanctions on Syria. In response Damascus criticized Washington harshly and said that the penalties reinforce hostilities in the region.



Deputy Foreign Minister Faysal Mekdad said the sanctions decision shows Washington has lost its credibility and failed to live up to its promises to Syria. "Obama is not serious about changing the relationship between the U.S. and Arab and Islamic states in the Middle East," Syrian officials said.

Hezbollah-Syria-Israel Triangle: On Tuesday, although there is still no evidence that Scud missiles were transferred to Hezbollah, the Israeli army's head of intelligence research, Brigadier General Yossi Baidatz, told the Knesset that the Scud transfer was the "tip of the iceberg", .
"Even today Hezbollah has missiles of all ranges types, including solid-fueled rockets that have a longer range are extremely accurate."

Baidatz then drew the picture of a multiple threat:
Hezbollah's long-range rockets allow them to position launchers deep within Lebanese territory and cover ranges far greater than we aware of in the past.

Hezbollah in 2010 is very different to Hezbollah in 2006 in terms of military capability, which has advanced a great deal. Hezbollah is now regarded by the Syrians as a component of their defense establishment.

Lastly and paradoxically,Baidatz stated that a political settlement with Israel is still a priority for Damascus:
A political settlement with Israel is high on Syria's list of priorities and intelligence shows a will to reach an agreement – but on their terms, meaning a return of the Golan Heights and American involvement.

Military intelligence believes Syria could radically alter its role – but Assad feels that political progress with the current Israel government is impossible and has therefore avoided confidence-building measures.
